Terms of Service

1. Acceptance of Terms

By accessing or using AskJibu ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

If you do not agree to these Terms, you may not use the Service.

2. Description of Service

AskJibu is a Business AI platform that allows businesses to create AI-powered assistants trained on their own knowledge base. The Service includes:

  • A dashboard for creating and managing AI assistants
  • Tools for uploading and managing business knowledge sources
  • An embeddable chat widget for websites
  • Analytics and lead capture tools
  • A REST API for custom integrations

AskJibu is a platform for business use. It is not designed for personal, household, or consumer use. The AI responses generated are based on your provided knowledge base and are not a substitute for professional advice (legal, medical, financial, or otherwise).

3. Account Registration

To use AskJibu, you must:

  • Be at least 18 years old
  • Provide accurate, complete account information
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorised access to your account

You are responsible for all activity that occurs under your account. We are not liable for any loss resulting from unauthorised use of your account where you have failed to maintain the confidentiality of your credentials.

You may not create multiple accounts to circumvent usage limits or bans. We reserve the right to merge or terminate duplicate accounts.

4. Acceptable Use

You agree not to use AskJibu to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Upload content that is defamatory, obscene, or harmful
  • Collect personal data from your customers without appropriate consent
  • Spam, phish, or engage in deceptive practices
  • Reverse engineer, decompile, or attempt to extract the underlying AI models
  • Circumvent rate limits or usage restrictions
  • Resell or sublicense access to the Service without written permission
  • Use the Service to build a competing AI assistant platform
  • Impersonate another business or person

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, depending on the severity of the violation.

5. Business Data & Knowledge

You own your data. The knowledge you upload to AskJibu — documents, product data, FAQs, and other content — remains your property. By uploading content, you grant AskJibu a limited licence to process, store, and use that content solely to operate your AskJibu assistant.

You are responsible for ensuring you have the right to upload all content you provide. Do not upload content that infringes third-party intellectual property, contains confidential information you are not authorised to share, or violates any applicable law.

We will not use your business knowledge to train shared AI models or to power other customers' assistants. Your knowledge base is isolated and private.

6. Subscription & Billing

AskJibu offers paid subscription plans in addition to the free Starter tier. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring monthly or annual basis.

  • Billing cycle: Subscriptions renew automatically unless cancelled before the renewal date
  • Proration: If you upgrade mid-cycle, you will be charged a prorated amount for the remaining period
  • Downgrade: Downgrades take effect at the start of the next billing cycle
  • Refunds: We do not offer refunds for partial billing periods, except where required by law
  • Price changes: We will give 30 days' notice before changing subscription prices
  • Failed payments: If payment fails, we will retry for 7 days before suspending your account

7. Free Tier Limitations

The free Starter plan is subject to usage limits (500 conversations/month, 1 assistant, 5 knowledge sources). We reserve the right to change free tier limits at any time with 30 days' notice.

The free tier is provided without any service level agreement (SLA). We will make reasonable efforts to maintain availability but do not guarantee uptime for free accounts.

We may discontinue the free tier at our discretion, with at least 60 days' notice to affected users.

8. Intellectual Property

The AskJibu platform, brand, software, AI models, and underlying technology are owned by AskJibu and its licensors. These Terms do not grant you any ownership rights in the Service.

The AI-generated responses produced by your AskJibu assistant are based on your knowledge base and are provided to you under the terms of your subscription. You may use these responses in your business operations.

The AskJibu name, logo, and brand marks may not be used without our prior written permission, except to factually state that your product or service uses AskJibu.

9. AI Limitations Disclaimer

AskJibu responses are generated by AI and are based on the knowledge you provide. While we work hard to ensure accuracy, AI systems can make mistakes.

You are responsible for reviewing AI-generated responses for accuracy before they are used in customer-facing contexts, especially for:

  • Medical, legal, or financial advice
  • Product pricing and availability (ensure your knowledge base is up to date)
  • Safety-critical information

AskJibu does not warrant that responses will be accurate, complete, or appropriate for any specific purpose. You accept responsibility for how your AskJibu assistant is used.

10. Indemnification

You agree to indemnify, defend, and hold harmless AskJibu and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Content you upload or provide
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party

11. Limitation of Liability

To the maximum extent permitted by applicable law, AskJibu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to AskJibu in the 12 months preceding the claim, or (b) USD 100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in full.

12. Termination

By you: You may cancel your account at any time from your dashboard settings. Cancellation takes effect at the end of the current billing period for paid plans.

By us: We may suspend or terminate your account if you violate these Terms, fail to pay, or if we cease to offer the Service. We will give reasonable notice where possible, except for serious violations.

Data export: After termination, you have 30 days to export your data (knowledge sources, conversation logs, lead data). After 30 days, your data will be permanently deleted.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles. However, we aim to operate in compliance with applicable laws across all African jurisdictions we serve.

14. Dispute Resolution

In the event of a dispute, we encourage you to first contact us at [email protected] to resolve the matter informally. We will make a good-faith effort to resolve disputes within 30 days.

If informal resolution fails, disputes shall be submitted to binding arbitration under the rules of the Nairobi Centre for International Arbitration (NCIA). The language of arbitration shall be English.

15. Changes to Terms

We may update these Terms at any time. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance.

If you disagree with updated Terms, you may cancel your account before the changes take effect.
